§2 LEISTUNG / SERVICES
DE: Der Anbieter erteilt live, synchronen Online-Musikunterricht (Einzelunterricht 1:1) über eine Videokonferenzplattform (z. B. Zoom) und bietet ergänzend strukturierte Kurse/Programme sowie die Angebote FKL (www.freekeylessons.com) und KKL (www.klavierkostenlos.com) an. Der Live-Unterricht ist interaktiv und in Echtzeit; kein Selbstlern-Fernunterricht. Unterrichtssprache: Deutsch oder Englisch nach Vereinbarung.
EN: The provider gives live, synchronous online music lessons (1:1 private lessons) via a video conferencing platform (e.g. Zoom) and additionally offers structured courses/programs as well as the FKL (www.freekeylessons.com) and KKL (www.klavierkostenlos.com) offerings. Live lessons are interactive and real-time; not self-study distance learning. Lesson language: German or English by agreement.
§3 PAKETE & PREISE / PACKAGES & PRICES
DE: Alle Preise werden als Endpreis (brutto) angezeigt. Für Verbraucher in Portugal/der EU ist die gesetzliche IVA (Azoren derzeit 16 %) enthalten; für Verbraucher außerhalb der EU (z. B. USA) fällt keine EU-IVA an. Es gilt die jeweils aktuelle Preisliste. FKL (FreeKeyLessons): digitale Videokurse als Einmalzahlung, lebenslanger Zugang – kein Abo. KKL (Klavier Kostenlos): digitale Videokurse als Einmalzahlung, lebenslanger Zugang – kein Abo. ML-Economic (45): 12 Live-Einheiten (45 Min) innerhalb von 4 Monaten – 145 €/Monat in 4 festen Monatsraten. ML-Economic Paket (4 Monate): dieselben 12 Einheiten, zahlbar in 4 Raten zu je 145 € oder als Einmalzahlung 522 € (10 % Rabatt). Serious Student 45: 4 Live-Einheiten/Monat (45 Min) + WhatsApp-Support – 189 €/Monat, 6 Monate fest. Ambitious Student 60: 4 Live-Einheiten/Monat (60 Min) + Übungsplan – 229 €/Monat, 6 Monate fest. ML-Music Theory: 4 Live-Einheiten/Monat (30 Min) – 100 €/Monat, 6 Monate fest. ML-Melodica (Kinder 6–8 J.): 99 €/Monat, 12 Monate fest. Fröhliche Tasten (Kinder): 30-Minuten-Einheiten, drei Vertragslaufzeiten – siehe §4; Fröhliche Tasten Plus (45 Min): 150 €/Monat (CHF 260/Monat · $174/Monat), 12 Monate fest. Einmalige Anmeldegebühr 5 € (außer ML-Economic Paket). Kunden in der Schweiz zahlen in CHF: ML-Economic 250 CHF/Monat (Paket: 4 × 250 CHF oder einmalig 900 CHF), Serious 325 CHF/Monat, Ambitious 395 CHF/Monat, Music Theory 170 CHF/Monat, Melodica 170 CHF/Monat, Fröhliche Tasten Plus 260 CHF/Monat; Anmeldegebühr 9 CHF.

Fröhliche Tasten (Kids): 30-minute lessons, three contract periods – see §4; Happy Keys Plus (45 min): €150/month (CHF 260 · $174), fixed 12 months. One-time joining fee €5 ($6), except the ML-Economic Package. Customers in Switzerland pay in CHF: ML-Economic CHF 250/month (package: 4 × CHF 250 or one-time CHF 900), Serious CHF 325/month, Ambitious CHF 395/month, Music Theory CHF 170/month, Melodica CHF 170/month, Happy Keys Plus CHF 260/month; joining fee CHF 9. For customers in the United States, prices are also shown in USD (indicative conversion at current exchange rate).
Total sums: €351 / €630 / €1,188 / €1,800. The 3/6/12-month packages have a fixed term without auto-renewal; Plus also has a fixed 12-month term without auto-renewal.
§4 FRÖHLICHE TASTEN (KINDER) / KIDS PROGRAM
DE: Fröhliche Tasten ist das Online-Musikprogramm für Kinder (Einzelunterricht 1:1, live per Zoom), nach dem Schul-/Jahreskalender (Anlage 1). Es gelten folgende Pakete — alle Preise inkl. 16 % MwSt., zzgl. einmaliger Anmeldegebühr von 5 €:
• 3 Monate: 10 Live-Einheiten (je 30 Min) — 117 €/Monat (CHF 200/Monat · $136/Monat)
• 6 Monate: 19 Live-Einheiten (je 30 Min) — 105 €/Monat (CHF 180/Monat · $122/Monat)
• 12 Monate: 41 Live-Einheiten/Jahr (je 30 Min) — 99 €/Monat (CHF 170/Monat · $115/Monat)
• Plus: 41 Live-Einheiten/Jahr (je 45 Min), ältere/fortgeschrittene Kinder — 150 €/Monat (CHF 260/Monat · $174/Monat), 12 monatliche Abbuchungen
Gesamtbeträge: 351 € / 630 € / 1.188 € / 1.800 €. Die Pakete 3/6/12 Monate haben feste Laufzeit ohne automatische Verlängerung; auch Plus hat eine feste Laufzeit von 12 Monaten ohne automatische Verlängerung.
EN: Happy Keys is the online music program for kids (1:1 private lessons, live via Zoom), following the school/calendar year (Annex 1). The following packages apply — all prices incl. 16% VAT, plus a one-time €5 joining fee:
• 3 months: 10 live lessons (30 min each) — €117/month (CHF 200/month · $136/month)
• 6 months: 19 live lessons (30 min each) — €105/month (CHF 180/month · $122/month)
• 12 months: 41 live lessons/year (30 min each) — €99/month (CHF 170/month · $115/month)
• Plus: 41 live lessons/year (45 min each), older/advanced kids — €150/month (CHF 260/month · $174/month), 12 monthly debits
Total sums: €351 / €630 / €1,188 / €1,800. The 3/6/12-month packages have a fixed term without auto-renewal; Plus also has a fixed 12-month term without auto-renewal.
§5 ZAHLUNG & ZAHLUNGSVERZUG / PAYMENT & LATE PAYMENT
DE: Zahlung monatlich wiederkehrend und automatisch über den beim Checkout angebotenen Zahlungsanbieter (Stripe oder Wix Payments; z. B. Kreditkarte, Apple Pay, Google Pay oder SEPA-Lastschrift). Alle Preise sind Endpreise inkl. MwSt. Wird eine fällige Zahlung nicht eingezogen, sind wir berechtigt, den Unterricht bis zum Zahlungseingang auszusetzen; wir informieren Sie per E-Mail und setzen eine Frist von 7 Tagen. Bei von Ihnen zu vertretender Rücklastschrift tragen Sie die tatsächlich entstehenden Bankgebühren; für die Mahnung nach 14 Tagen berechnen wir pauschal 3 € (Nachweis geringeren Aufwands vorbehalten). Die Anmeldegebühr (5 €) wird nur bei wirksamem Widerruf erstattet. Einzelheiten: Vertragsunterlagen, Ziffer 4.
EN: Payment is monthly recurring and automatic, via the payment provider offered at checkout (Stripe or Wix Payments; e.g. credit card, Apple Pay, Google Pay or SEPA direct debit). All prices are final prices incl. VAT. If a due payment is not collected, we are entitled to suspend lessons until payment is received; we will inform you by email and set a period of 7 days. For a failed direct debit you are responsible for, you bear the bank fees actually incurred; for the reminder after 14 days we charge a flat €3 (proof of lower effort reserved). The joining fee (€5) is refunded only upon valid withdrawal. Details: contract documents, Section 4.
§6 UNTERRICHTSKALENDER & FERIEN / LESSON CALENDAR & HOLIDAYS
DE: Es gilt der eigene ML-Schuljahreskalender (unabhängig von regionalen Schulferien). Die konkreten ferienfreien Zeiten sowie die Regelungen zu Terminverschiebung, Vertragsverlängerung und Paketwechsel sind in der dem Vertrag beigefügten Dokumentation geregelt.
EN: The provider's own ML school-year calendar applies (independent of regional school holidays). The specific holiday periods and the rules on rescheduling, contract renewal and package changes are set out in the documentation attached to the contract.
§7 ABSAGEN & STORNIERUNG / CANCELLATION OF LESSONS
DE: Kostenfrei bis mindestens 24 Stunden vorher. Erscheint der Schüler mehr als 10 Minuten nach Beginn nicht und wurde nicht rechtzeitig verschoben, gilt die Einheit als abgehalten. Absage durch den Lehrer: kostenloser Ersatztermin oder Gutschrift. Ist eine Einheit beidseitig nicht durchführbar, werden 2-3 Ausweichtermine angeboten. Krankheit mit Nachweis: kulante Lösung.
EN: Free up to at least 24 hours in advance. If the student does not appear within more than 10 minutes after the start and the lesson was not rescheduled in time, the lesson counts as held. Cancellation by the teacher: free replacement date or credit. If a lesson cannot take place on both sides, 2-3 alternative dates are offered. Illness with proof: a considerate solution is provided.
§8 VERTRAGSDAUER, VERLÄNGERUNG & KÜNDIGUNG / CONTRACT TERM, RENEWAL & TERMINATION
DE: Laufzeit: fest nach gebuchtem Paket – ML-ECONOMIC 4 Monate, ML-SERIOUS STUDENT und ML-AMBITIOUS STUDENT 6 Monate, Kinder-Pakete 3, 6 oder 12 Monate (Happy Keys Plus 12 Monate). Eine ordentliche Kündigung während der Laufzeit ist nicht möglich; das Recht zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt. Der Vertrag endet automatisch mit Ablauf der Laufzeit – es gibt keine automatische Verlängerung. Für eine Fortsetzung wird einfach ein neues Paket gebucht. Das gesetzliche Widerrufsrecht bleibt unberührt, siehe §8a (Widerrufsbelehrung).
EN: Term: fixed according to the booked package – ML-ECONOMIC 4 months, ML-SERIOUS STUDENT and ML-AMBITIOUS STUDENT 6 months, kids packages 3, 6 or 12 months (Happy Keys Plus 12 months). Ordinary termination during the term is not possible; the right to terminate for good cause remains unaffected. The contract ends automatically at the end of the term – there is no automatic renewal. To continue, simply book a new package. The statutory right of withdrawal remains unaffected, see §8a (withdrawal notice).
§8a WIDERRUFSBELEHRUNG / WITHDRAWAL NOTICE
DE: Verbrauchern innerhalb der EU steht ein gesetzliches Widerrufsrecht zu; für Verbraucher in Österreich gilt zusätzlich §11 FAGG. Widerrufsbelehrung: Sie haben das Recht, binnen 14 Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt 14 Tage ab dem Tag des Vertragsschlusses. Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Mirco Lieber, MMag., Estrada Regional da Relva 240, 9500-655 Ponta Delgada, Portugal, E-Mail: [email protected]) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das untenstehende Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs: Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Anmeldegebühr, unverzüglich und spätestens binnen 14 Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben.
Haben Sie verlangt, dass der Unterricht während der Widerrufsfrist beginnen soll, so haben Sie uns einen angemessenen Betrag zu zahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts unterrichten, bereits erbrachten Leistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Leistungen entspricht.

EN: EU consumers have a statutory right of withdrawal; consumers in Austria are additionally covered by §11 FAGG. Withdrawal notice: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of conclusion of the contract. To exercise the right of withdrawal, you must inform us (Mirco Lieber, MMag., Estrada Regional da Relva 240, 9500-655 Ponta Delgada, Portugal, email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the joining fee, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.
If you requested that the lessons begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

§9 TECHNISCHE VORAUSSETZUNGEN / TECHNICAL REQUIREMENTS
DE: Der Schüler stellt sicher: stabile Internetverbindung, geeignetes Gerät mit Kamera/Mikrofon, ruhige Umgebung.
EN: The student ensures: stable internet connection, suitable device with camera/microphone, quiet environment.
§10 AUFZEICHNUNG, URHEBERRECHT & DATENSCHUTZ / RECORDING, COPYRIGHT & PRIVACY
DE: Aufzeichnungen nur mit gesonderter Zustimmung. Materialien und Kursinhalte sind urheberrechtlich geschützt und nur zum persönlichen Gebrauch; Weitergabe, Vervielfältigung oder öffentliche Zugänglichmachung nicht gestattet. Es gilt die Datenschutzerklärung unter ml-musikschule.eu/datenschutz (DSGVO-konform). Drittanbieter: u. a. Zoom (Unterricht), Stripe, Wix Payments und Music Teacher Pros (Zahlung/Buchung).
EN: Recordings only with separate consent. Materials and course content are copyright-protected and for personal use only; sharing, reproduction or making publicly available is not permitted. The privacy policy at ml-musikschule.eu/datenschutz applies (GDPR-compliant). Third parties: incl. Zoom (lessons), Stripe, Wix Payments and Music Teacher Pros (payment/booking).
§11 ZUFRIEDENHEITSZUSAGE / SATISFACTION GUARANTEE
DE: Sind Sie mit einer Einheit nicht zufrieden, melden Sie sich bitte binnen 48 Stunden. Wir bieten einen kostenlosen Ersatztermin oder eine Gutschrift. Dies gilt nicht, wenn eine Einheit allein aufgrund Ihres eigenen Verhaltens versäumt wurde.
EN: If you are not satisfied with a lesson, please contact us within 48 hours. We offer a free replacement date or a credit. This does not apply if a lesson was missed solely due to your own conduct.
§12 HAFTUNG / LIABILITY
DE: Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei schuldhafter Verletzung von Leben, Körper oder Gesundheit. Bei einfacher Fahrlässigkeit nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Im Übrigen ist die Haftung ausgeschlossen. Zwingende gesetzliche Haftung (z. B. Produkthaftung) bleibt unberührt.
EN: The provider is liable without limitation for intent and gross negligence as well as for culpable injury to life, body or health. In cases of simple negligence, liability applies only for breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable damage. Otherwise liability is excluded. Mandatory statutory liability (e.g. product liability) remains unaffected.
§13 ÄNDERUNGEN DIESER AGB / CHANGES TO THESE TERMS
DE: Änderungen werden Ihnen mindestens 6 Wochen vor Inkrafttreten in Textform mitgeteilt. Sie können widersprechen; im Fall des Widerspruchs gelten die bisherigen Bedingungen bis zum Ende der laufenden Laufzeit fort.
EN: Changes will be communicated to you in text form at least 6 weeks before they take effect. You may object; in the event of objection, the previous conditions continue to apply until the end of the current term.
§14 RECHTSWAHL / GOVERNING LAW
DE: Es gilt portugiesisches Recht. Zwingende Verbraucherschutzvorschriften des Staates, in dem Sie Ihren gewöhnlichen Aufenthalt haben, bleiben unberührt.
EN: Portuguese law applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
§15 BUCHUNG & NACHWEIS / BOOKING & RECORD
DE: Termine werden über Music Teacher Pros geplant; der Schüler erhält automatisch Bestätigung und Zoom-Link. Jede gehaltene Einheit wird digital protokolliert und dem Guthaben angerechnet.
EN: Appointments are scheduled via Music Teacher Pros; the student automatically receives confirmation and the Zoom link. Each held lesson is digitally recorded and credited to the balance.
§16 KI-EINSATZ (TRANSPARENZHINWEIS) / AI USE (TRANSPARENCY NOTICE)
DE: Der Anbieter setzt unterstützend KI ein: Music Teacher Pros nutzt KI-Chatbot-Funktionen; auf der Website kann ein KI-Chat-Assistent allgemeine Fragen beantworten (Weiterleitung an Mirco Lieber jederzeit möglich); KI kann bei der Erstellung individueller Lehrpläne helfen (fachliche Verantwortung liegt stets bei Mirco Lieber, MMag.); Sitzungsaufzeichnungen können mittels KI transkribiert werden. Keine automatisierte Entscheidungsfindung (Art. 22 DSGVO). Der Unterricht erfolgt stets live und persönlich.
EN: The provider uses AI in a supporting role: Music Teacher Pros uses AI chatbot functions; an AI chat assistant on the website may answer general questions (referral to Mirco Lieber is always possible); AI may assist in creating individual lesson plans (professional responsibility always remains with Mirco Lieber, MMag.); session recordings may be transcribed using AI. No automated decision-making (Art. 22 GDPR). Lessons are always live and personal.
§17 SCHLUSSBESTIMMUNGEN / FINAL PROVISIONS
DE: Sollte eine Bestimmung unwirksam sein, bleibt der übrige Vertrag wirksam. An die Stelle der unwirksamen Bestimmung tritt die gesetzliche Regelung.
EN: Should any provision be invalid, the remainder of the contract remains valid. The invalid provision is replaced by the statutory regulation.
